CUSTOMER SERVICE, REPAIR, WARRANTY AND PRIVACY TERMS

Canadian Auto Remarketing (CAR) Ltd., doing business as Canadian Auto Napa Auto Care, is referred to in these terms as “Canadian Auto,” “we,” “us,” or “our.”

THESE TERMS CONTAIN

PART I — CUSTOMER SERVICE, REPAIR AND WARRANTY TERMS

PART II — PRIVACY POLICY

By requesting, authorizing, or accepting inspection, diagnostic, maintenance, repair, tire, wheel, or other automotive services from Canadian Auto, the customer agrees to the terms in Part I.

Part II applies whenever an individual visits our website, contacts us, requests services, conducts business with us, or otherwise interacts with Canadian Auto.

PART I — CUSTOMER SERVICE, REPAIR AND WARRANTY TERMS

  1. REPAIR AUTHORIZATION

Canadian Auto will perform only the inspection, diagnostic work, maintenance, repairs, and other automotive services authorized by the customer.

Authorization may be provided in writing, electronically, verbally where legally permitted, or through another legally permitted method. Canadian Auto may document the authorization in its business records.

Canadian Auto will obtain any additional authorization required by law before performing additional work that has not already been authorized.

If Canadian Auto recommends additional work and cannot reach the customer, work may be stopped until authorization is received. Canadian Auto is not required to perform unauthorized repairs merely because a vehicle may be unsafe, disabled, or at risk of further deterioration.

The customer authorizes Canadian Auto and its employees or agents to operate, move, park, and road-test the vehicle as reasonably necessary for diagnosis, repair, quality-control testing, storage, and verification of completed work.

  1. ESTIMATES, DIAGNOSTIC WORK, AND ADDITIONAL COSTS

When an estimate is requested, Canadian Auto will provide it in accordance with applicable Alberta law.

An estimate is based on the information and vehicle conditions known when the estimate is prepared. Hidden damage, diagnostic findings, corrosion, seized or damaged components, previous repairs, modifications, deterioration, or other conditions may result in additional work or costs being recommended.

Canadian Auto will not exceed an estimate beyond the amount permitted by applicable law without obtaining any further authorization required by law.

Diagnostic, inspection, testing, and teardown work is billable when authorized. These charges remain payable whether:

  • The customer proceeds with the recommended repair.
  • The vehicle can be repaired.
  • The diagnosis identifies more than one problem.
  • Required parts are available.
  • The repair is economically practical.
  • The diagnostic work results in a completed repair.

Authorization for diagnostic or teardown work does not guarantee that a repair can be completed.

All estimates are valid for 30 days. Work performed more than 30 days after the original assessment may require reinspection and may be subject to price adjustments.

  1. REPAIR ADVISORY FOR OLDER, HIGH-KILOMETRE, OR DETERIORATED VEHICLES

The provisions in this section apply particularly to:

  • Vehicles more than 10 years old.
  • Vehicles with higher-than-average kilometres.
  • Vehicles showing significant wear, corrosion, rust, or deterioration.
  • Vehicles with previous repairs, modifications, or age-related concerns.

Completion of a specific repair does not mean the entire vehicle has been inspected, restored, or guaranteed to be mechanically dependable or roadworthy.

During diagnosis or repair, additional defects may be discovered. Components may break, seize, strip, crack, leak, or fail because of age, corrosion, deterioration, ordinary wear, previous repairs, or improper prior installation.

Repairing one condition may also reveal another hidden, unrelated, or intermittent problem. A later failure or additional repair recommendation does not, by itself, establish that the original diagnosis or repair was incorrect.

Unless specifically stated in writing, Canadian Auto does not guarantee the overall condition, future reliability, remaining service life, or roadworthiness of an older or high-kilometre vehicle.

The customer acknowledges that additional problems and repair costs may arise because of the vehicle’s age, mileage, condition, maintenance history, modifications, or previous repairs.

Canadian Auto NAPA Auto Care may advise a customer against proceeding with certain repairs when, in our professional opinion, the estimated cost of the repair may not be economically reasonable in relation to the vehicle’s age, mileage, overall condition, or current market value.

Older or high-mileage vehicles may have additional worn, deteriorated, corroded, or near-failure components that are not apparent at the time of the initial inspection or repair. Completing one repair does not guarantee that other components will not require repair or replacement in the future.

Where appropriate, Canadian Auto NAPA Auto Care may discuss these concerns with the Customer and recommend that the Customer consider the overall condition and value of the vehicle before authorizing significant repairs.

Any such recommendation is advisory only. The final decision to proceed with, postpone, or decline repairs remains solely with the Customer.

If the Customer chooses to proceed after being advised of these concerns, the Customer acknowledges that additional repairs or expenses may arise in the future and that Canadian Auto NAPA Auto Care cannot guarantee the future reliability or remaining service life of the vehicle or its other components.

  1. PRE-EXISTING CONDITIONS AND COMPONENT FAILURE

Canadian Auto will use reasonable care when inspecting and servicing a vehicle.

To the extent permitted by law, Canadian Auto is not responsible for damage or component failure caused solely by a pre-existing condition, including:

  • Corrosion or rust.
  • Seized, damaged, stretched, or cross-threaded fasteners.
  • Damaged studs, lug nuts, wheels, or rims.
  • Previous over-torquing or improper installation.
  • Deteriorated plastic, rubber, wiring, or connectors.
  • Previously damaged, improperly repaired, or weakened components.
  • Modifications or repairs performed by another person.
  • Normal age-related deterioration or ordinary wear.

If a component breaks or fails because it was previously damaged, corroded, seized, deteriorated, or weakened, any resulting repair will be treated as additional work and will not be included in the original price unless specifically authorized.

Where additional authorization is required by law, Canadian Auto will advise the customer and obtain authorization before completing the additional work.

  1. CUSTOMER-SUPPLIED PARTS

Canadian Auto may refuse to install any customer-supplied part or equipment that Canadian Auto considers unsafe, defective, damaged, inappropriate, incompatible, or unsuitable for the vehicle or intended repair.

Any warranty relating to a customer-supplied part is subject to Canadian Auto’s applicable written warranty terms, if any, and the terms of the manufacturers or supplier’s warranty.

  1. REPLACED PARTS

Replaced parts will be returned to the customer only when requested before or at the time the vehicle is picked up.

The return of replaced parts is subject to legal, environmental, warranty, and core-return requirements.

Hazardous materials, fluids, parts retained for warranty review, and parts that must be returned as cores may not be available for return.

Replaced parts that have not been requested may be recycled or disposed of after the repair is completed.

  1. SHOP-SUPPLIES CHARGES

A shop-supplies charge may be applied where the charge has been disclosed and authorized as required by law.

Shop supplies may include ordinary consumable materials used during inspection, repair, or maintenance that are not practical to itemize individually, including:

  • Cleaners and degreasers.
  • Lubricants and penetrating fluids.
  • Shop towels and disposable gloves.
  • Small nuts, bolts, clips, washers, and fasteners.
  • Electrical tape, heat-shrink tubing, and wire ties.
  • Sealants and RTV.
  • Thread-locking and anti-seize compounds.
  • Dielectric grease.
  • Absorbent materials.
  • Similar minor consumables.

Shop supplies do not normally include major fluids, filters, tires, batteries, replacement components, or other parts separately itemized on an estimate, repair order, or invoice.

  1. REPAIR RESULTS

Automotive diagnosis and repair involve mechanical, electrical, and electronic systems that may contain multiple, concealed, or intermittent faults.

Canadian Auto does not guarantee that an authorized repair will correct every symptom, intermittent fault, or unrelated condition affecting the vehicle.

Completion of an authorized repair does not constitute a guarantee regarding the condition of components or systems that were not included in the authorized work.

Any warranty on Canadian Auto’s workmanship or supplied parts is governed by the written warranty terms applicable to the repair.

  1. MAINTENANCE RECORDS

The customer is responsible for retaining complete maintenance and repair records where documentation is required for warranty coverage.

Records should include, where applicable:

  • The service date.
  • The vehicle’s odometer reading.
  • A description of the work performed.
  • Parts and filters installed.
  • Fluids and specifications used.
  • Supporting invoices and receipts.

Maintenance should be completed within the intervals required by the applicable vehicle manufacturer and the terms of any applicable warranty.

Where Canadian Auto has issued a separate written warranty containing specific maintenance requirements, the customer must comply with those requirements to the extent permitted by law.

  1. THIRD-PARTY, EXTENDED, MANUFACTURER, AND NAPA WARRANTIES

Manufacturer warranties, supplier warranties, extended warranties, protection plans, third-party warranties, and NAPA warranties are governed by their own terms, limitations, exclusions, and claims procedures.

Canadian Auto does not independently determine or alter the contractual terms of a third-party warranty.

The customer is responsible for providing any maintenance or repair documentation required by the warranty administrator.

Failure to provide required documentation may result in a claim being delayed or denied or may otherwise affect coverage, subject to the actual warranty terms.

Submitting a warranty claim or maintenance records does not guarantee that the claim will be approved.

  1. CANADIAN AUTO WARRANTY CLAIMS

Any warranty provided directly by Canadian Auto applies only according to the written warranty terms supplied with the applicable repair.

Before arranging repair elsewhere for an alleged warranty issue, the customer should contact Canadian Auto and provide Canadian Auto with a reasonable opportunity to inspect the vehicle and the alleged defect.

Unauthorized alteration or repair by another party that prevents Canadian Auto from determining the cause of an alleged failure may affect warranty eligibility to the extent permitted by law.

  1. WHEEL AND TIRE RETORQUE

When a wheel has been removed and reinstalled, the customer must return the vehicle to Canadian Auto after 100 to 150 kilometres for a complimentary wheel-nut retorque unless Canadian Auto provides different written instructions.

No appointment is normally required.

Failure to return for the recommended retorque may increase the risk of wheel-nut loosening, wheel separation, or related damage.

To the extent permitted by law, Canadian Auto is not responsible for loss or damage caused or contributed to by the customer’s failure to follow the retorque instruction.

  1. UNSAFE VEHICLES AND DECLINED REPAIRS

If Canadian Auto determines that a vehicle appears unsafe to operate, Canadian Auto may:

  • Advise the customer of the unsafe condition.
  • Explain the reason for the safety concern.
  • Recommend corrective repairs.
  • Recommend that the vehicle be towed rather than driven.
  • Document the condition and the customer’s decision.

Subject to any lawful right of lien or possession, Canadian Auto will not physically prevent the customer from removing a vehicle solely because Canadian Auto considers it unsafe.

If Canadian Auto believes that a vehicle presents an immediate danger to public safety, Canadian Auto may contact law enforcement or another appropriate authority.

The customer accepts responsibility for choosing to operate or remove a vehicle after being advised of an unsafe or unrepaired condition.

  1. PAYMENT

Unless Canadian Auto has approved other written payment arrangements, payment in full is due when the authorized work is completed and before the vehicle is released.

Approved fleet accounts are payable within 30 days of the invoice date.

Overdue amounts may bear interest at 2% per month, equivalent to 24% per year, subject to applicable law.

The customer is responsible for lawful collection, enforcement, and recovery costs that the customer has agreed to pay or that may legally be recovered.

Canadian Auto may exercise any lawful lien or other remedy available for unpaid repair, maintenance, storage, or related charges.

  1. STORAGE FEES AND UNCLAIMED VEHICLES

Canadian Auto will make reasonable efforts to notify the customer when the vehicle is ready for pickup.

Unless prior written arrangements have been made, a vehicle not collected within seven calendar days after notice that it is ready may be charged a storage fee of $70 per day. The storage fee will begin after the seven-day period.

Storage charges will continue until the vehicle is collected or otherwise lawfully removed or dealt with.

If a vehicle remains unpaid or unclaimed, Canadian Auto may exercise any lien, seizure, sale, storage, or other remedy available under the Garage Keepers’ Lien Act, other applicable Alberta legislation, or other applicable law.

A vehicle does not become the property of Canadian Auto merely because it remains on the premises for a specified period. Any enforcement, seizure, sale, or disposal will be managed in accordance with applicable legal requirements.

  1. VEHICLES AND PERSONAL PROPERTY ON THE PREMISES

Customers should remove cash, valuables, and unnecessary private property from the vehicle before leaving it with Canadian Auto.

To the extent permitted by law, Canadian Auto is not responsible for loss or damage caused solely by theft, vandalism, fire, severe weather, hail, flooding, or another event beyond Canadian Auto’s reasonable control.

This provision does not apply to the extent that loss or damage was caused by Canadian Auto’s negligence or wilful misconduct.

  1. LIMITATION OF LIABILITY

To the extent permitted by law, Canadian Auto is not responsible for indirect, incidental, special, or consequential loss arising from:

  • Vehicle downtime.
  • Loss of use.
  • Missed appointments.
  • Lost income.
  • Business interruption.
  • Similar consequential losses.

Nothing in these terms excludes, restricts, or limits any right, remedy, warranty, or liability that cannot lawfully be excluded, restricted, or limited.

  1. ENTIRE SERVICE AGREEMENT

The applicable repair order, approved estimate, additional authorizations, invoice, written warranty documents, and Part I of these terms together form the service agreement applicable to the work performed.

If a specific written authorization or warranty provision conflicts with a general provision in Part I, the more specific written term will apply to that repair or warranty, subject to applicable law.

PART II — PRIVACY POLICY

  1. OUR PRIVACY COMMITMENT

Canadian Auto respects the privacy of its customers, website visitors, and other individuals and is committed to protecting personal information entrusted to us.

We oversee personal information in accordance with applicable Canadian privacy legislation, including Alberta’s Personal Information Protection Act and, where applicable, the federal Personal Information Protection and Electronic Documents Act.

Canadian Auto does not sell personal information.

  1. ACCOUNTABILITY

Canadian Auto is responsible for personal information under its control.

We have designated a Privacy Officer to oversee our privacy practices, respond to questions, and access requests, and address privacy concerns or complaints.

The Privacy Officer’s contact information appears at the end of this policy.

  1. PERSONAL INFORMATION WE MAY COLLECT

Depending on how an individual interacts with us, we may collect:

  • Name.
  • Mailing or residential address.
  • Email address.
  • Telephone number.
  • Vehicle make, model, year, VIN, mileage, licence plate information, and service history.
  • Appointment and service-request information.
  • Purchase and transaction history.
  • Payment and billing information.
  • Driver’s licence or other identification where required.
  • Information provided through website forms, telephone calls, emails, text messages, or in-person communications.
  • Financing, credit, employment, identification, or financial information voluntarily submitted for an applicable service.

When an individual uses our website, we may automatically collect technical information such as:

  • IP address.
  • Browser and device type.
  • Operating system.
  • Pages visited.
  • Referring website.
  • Date and time of access.
  • General website usage and analytics information.

We limit the collection of personal information to information required for legitimate business purposes.

  1. WHY WE COLLECT AND USE PERSONAL INFORMATION

Canadian Auto may collect and use personal information to:

  • Schedule and provide automotive repair, maintenance, inspection, diagnostic, tire, wheel, and related services.
  • Respond to questions, estimate requests, appointment requests, and customer inquiries.
  • Prepare work orders, estimates, invoices, warranties, and service records.
  • Maintain vehicle maintenance and repair histories.
  • Process purchases and payments.
  • Communicate regarding appointments, repairs, estimates, parts, warranties, recalls, and completed services.
  • Provide customer support.
  • Verify identity where necessary.
  • Administer financing or credit applications where those services are offered.
  • Detect or prevent fraud, misuse, or security incidents.
  • Improve our website, services, operations, and customer experience.
  • Maintain business, accounting, tax, insurance, and warranty records.
  • Collect amounts lawfully owing.
  • Meet legal, regulatory, contractual, and insurance requirements.
  • Send promotional or marketing communications where permitted by law and, where required, with consent.

If Canadian Auto intends to use personal information for a materially different purpose, we will obtain additional consent where required by law.

  1. CONSENT

Canadian Auto obtains consent for the collection, use, and disclosure of personal information where required by applicable privacy legislation.

The appropriate form of consent depends on the circumstances and the sensitivity of the information. Consent may be express or implied where permitted by law.

For example, when an individual provides contact information to request an appointment or automotive service, Canadian Auto may use that information to respond, communicate about the requested service, and maintain appropriate business records.

Canadian Auto will not require consent to collect, use, or disclose information beyond what is necessary to provide a requested product or service, except where permitted or required by law.

An individual may withdraw consent to certain uses of personal information, subject to legal, regulatory, contractual, and reasonable business restrictions. Withdrawing consent may affect our ability to provide certain products or services.

  1. FINANCING AND CREDIT INFORMATION

If Canadian Auto offers or facilitates financing or credit and an individual chooses to apply, we may collect the personal, employment, identification, financial, and credit-related information necessary to process the application.

With consent and where permitted by law, information may be provided to or obtained from:

  • Financial institutions.
  • Financing companies.
  • Lenders.
  • Credit-reporting agencies.
  • Other parties involved in evaluating or administering the application.

These parties may use the information to verify identity, assess creditworthiness, process an application, administer an approved account, prevent fraud, or meet legal requirements.

Additional disclosures or consent terms may apply to a particular financing application.

  1. DISCLOSURE OF PERSONAL INFORMATION

Canadian Auto may disclose personal information where necessary to:

  • Payment processors.
  • Website-hosting and information-technology providers.
  • Communications, accounting, analytics, and customer-management providers.
  • Parts suppliers.
  • Warranty administrators and manufacturers.
  • Insurers and other parties involved in providing a requested automotive service.
  • Financial institutions, lenders, and credit-reporting agencies where financing or credit services have been requested.
  • Collection or enforcement providers.
  • Professional advisers, including accountants, lawyers, and insurers.
  • Government agencies, regulators, law-enforcement authorities, or courts where permitted or required by law.
  • A purchaser, successor, or other party in connection with an actual or proposed business transaction, subject to applicable privacy requirements.

Service providers are given only the personal information necessary to perform their services for Canadian Auto.

  1. PROCESSING OUTSIDE ALBERTA OR CANADA

Some service providers used by Canadian Auto may store or process personal information outside Alberta or outside Canada.

When information is processed in another jurisdiction, it may be subject to the laws of that jurisdiction and may be accessible to courts, governments, law-enforcement agencies, or regulatory authorities in accordance with local law.

Canadian Auto takes reasonable steps appropriate to the circumstances to protect personal information managed by service providers.

Questions about service providers located outside Canada may be directed to our Privacy Officer.

  1. LIMITING COLLECTION, USE, AND DISCLOSURE

Canadian Auto collects only the personal information necessary for identified and legitimate purposes.

We will not use or disclose personal information for a materially different purpose unless:

  • The individual provides consent.
  • The use or disclosure is otherwise permitted by law.
  • The use or disclosure is required by law.
  1. RETENTION AND DISPOSAL

Canadian Auto retains personal information only for as long as reasonably necessary to:

  • Provide requested products or services.
  • Maintain appropriate customer and vehicle service records.
  • Complete transactions.
  • Fulfil warranty obligations.
  • Resolve disputes.
  • Meet accounting, tax, insurance, legal, and regulatory requirements.
  • Protect legitimate business interests.

Retention periods may vary depending on the type of information and the purpose for which it was collected.

When personal information is no longer reasonably required, Canadian Auto takes appropriate steps to securely destroy, delete, or anonymize it.

Canadian Auto uses physical, administrative, and technological safeguards appropriate to the sensitivity of the personal information maintained.

These safeguards may include:

No method of electronic transmission or storage is completely secure. Canadian Auto cannot guarantee absolute security.

  1. PRIVACY AND SECURITY INCIDENTS

If personal information under Canadian Auto’s control is lost, accessed without authorization, or disclosed without authorization, we will assess the incident and take reasonable steps to contain and address it.

Where required by applicable privacy legislation, Canadian Auto will report qualifying privacy breaches to the appropriate privacy regulator and notify affected individuals as required.

  1. ACCURACY, ACCESS, AND CORRECTION

Canadian Auto takes reasonable steps to ensure that personal information used to make decisions about an individual is accurate, complete, and current.

Subject to applicable legal exceptions, an individual may request access to personal information Canadian Auto holds about them.

An individual may also ask Canadian Auto to:

  • Explain how their personal information has been used.
  • Identify certain parties to whom the information has been disclosed.
  • Correct inaccurate or incomplete information.

Canadian Auto may need to verify identity before processing an access or correction request.

Applicable privacy legislation may permit or require Canadian Auto to refuse access to certain information. Where legally permitted, Canadian Auto will explain the reason for a refusal.

Access and correction requests should be directed to our Privacy Officer.

Unsubscribing from marketing communications will not prevent Canadian Auto from sending communications required to provide requested services, administer a transaction, or provide essential information concerning an existing customer relationship.

Our website may contain links to websites or services operated by third parties.

Canadian Auto is not responsible for the privacy, security, or content practices of third-party websites or services.

Users should review the privacy policies of third-party websites and services before providing personal information to them.

  1. CHILDREN’S PRIVACY

Canadian Auto’s services are not directed toward children.

We do not knowingly collect personal information from children through our website except where necessary and permitted by law.

Anyone who believes a child has provided personal information to Canadian Auto without appropriate authorization should contact our Privacy Officer.

  1. QUESTIONS AND COMPLAINTS

Individuals may contact our Privacy Officer to:

  • Ask questions about this Privacy Policy.
  • Request access to personal information.
  • Request correction of personal information.

Canadian Auto will investigate privacy complaints and respond in accordance with applicable privacy legislation.

Canadian Auto may update these terms periodically to reflect changes in its practices, technology, services, business operations, or legal obligations.

The current version will be posted on our website with its effective date or last-updated date.

Material changes will be communicated in an appropriate manner where required by law.
